According to the City of Cape Coral, only driveways and mailboxes should be located within a utility easement on a residential lot. The easement is a 10 foot area measured from the street towards the home. Unfortunately, many homeowners throughout the city have planted trees and installed irrigation systems within the easement. If any work is required in that area then the cost of removal of homeowner's improvements falls on the homeowner.
Sidewalks continue to be installed throughout the city due to the receipt of state grants. Anything within the easement will have to be removed for the installation. It has been reported that a removal and replanting of a Royal Palm can cost upwards of $1,000. This is important to know if you are considering purchasing a home with improvements located in a utility easement or have thought about planting trees along the roadside in front of your home.
The best course of action is to plant and irrigate only within your yard. A survey will show all easements on your lot. Check with the City of Cape Coral for more information.
